Chilean Supreme Court sides with Sernapesca

The Chilean Supreme Court ratified the ruling by the Court of Appeals of Valparaíso and rejected a legal protection presented by Invermar against the National Fisheries and Aquaculture Service of Chile (Sernapesca).

Invermar filed the legal protection against Sernapesca with the aim of preventing the transmission of the virus Infectious Salmon Anaemia (ISA).

ISA is a viral disease of Atlantic salmon (Salmo Salar) that affects fish farms. It causes severe mortalities among the infected groups of fish.

According to Sernapesca, a unanimous judgment rejected the preventive action imposed by Invermar against the decision of Sernapesca to order an anticipated harvesting of one of the centers after detecting the presence of the virus.

The National Service Director, José Miguel Burgos, said “the judgment confirms that, through the declaration of emergency health, the state remains authorized to adopt a series of measures as the anticipated harvest, which should be adopted quickly for avoiding the spread of the outbreak and protect the sanitary status of the country.”
